DUI Case Dismissed

DUI Case Plus Other Charges Dropped

Nathan here a premium member. I contacted you few months ago regarding my DUI and other charges case. I do have a success story and a question as well.

Obtained a private administrative process contract and obtained and Arbitration award as well. I brought this award notice into the DUI court case.  The Court tried to ignore it as expected, and proceed with the current case separate from the Arbitration Award private matter. The judge even said it's the “State of Minnesota” against me, not the Prosecutor (even though prosecutor knows they represent the state), and decided to proceed with the DUI case anyway. I then noticed the Judge by her silence on the administrative award, she agrees with it and waives her immunity, if she decides to proceed with the DUI case, she is doing so under her personal capacity and therefore liable per the contract (ie: the Arbitration award proceeding contract). The judge then Set up a trial date for February 25th.

I just received a letter from a different prosecutor, dismissing the case with prejudice for the reason of Prosecutorial Discretion!

My question is it best to continue to enforce my award, or what I was thinking is writing the original Prosecutor an offer to settle. Please give me feedback. Thanks for your time. By the way there are a lot of things that took place during the case that i can't include, but if you want to know I'm here. God bless!  Case# 14-CR-19-2684

ANSWER: Our thought was take the rare victory and don’t get greedy. Lesson learned by the State and and the defendant. Don't drink and drive again…discover UBER!
