Remember this, even after you do your defensive actions, you will eventually need to file your own suit (claim) to force the lender to actually come forth the and produce the damaged party and contract.  No damaged party means no verified claim.  But unless YOU are the plaintiff, you rarely can win. Advance your claim vs fighting theirs.
