Debt Validation Stories

TJ explains that success stories from Premium members are important teaching aids, so members should share their debt validation successes with him.

  • PAUL shared a minor victory where a debt collector sent his debt back to the original creditor after receiving his validation letter. TJ advises Paul to stay organized and have the follow-up validation letters ready to send if needed. He also explains that debt collectors often give up easily, but original creditors may pursue further, requiring more effort. As an additional tool, TJ recommends putting assets into trusts to avoid appearing like an attractive target for lawsuits. He discusses how attorneys sort cases into piles based on whether debtors appear to have assets to go after.
  • ZYAIR asks about court procedures for a child custody case, and TJ advises focusing on presenting strong evidence-based facts.
  • DOWNES, who already has a judgment against him, asks about setting up a trust now, and TJ cautions that transferring assets after a judgment could be seen as evasion by the court; Follow the law. However, Dowens can still set up a trust going forward for future asset protection benefits.
  • MARK has filed small claims suits against three creditors who failed to validate the debts, and TJ recommends also notifying the credit bureaus about the lack of debt validation before that.
  • Mark and TJ discussed the process of handling a small claims case against Chrysler. Mark shared his experience of sending a letter to Chrysler and the credit bureaus, and TJ advised him on how to handle the case, including the importance of not admitting to anything in court and the potential for arbitration. They also discussed the possibility of asking for a default judgment if the other party fails to appear in court.
  • BOUYEA asked about the possibility of reactivating an old irrevocable trust, to which TJ advised her to consult a lawyer and not to rely on the 10 year old trust due to potential issues with the IRS. Tax Issues and Collection Process – TJ and Bouyea discussed the process of dealing with tax issues and the potential use of a Collection Due Process request. TJ explained that this process could stop all collection action and provide leverage in negotiations. He also mentioned the importance of attaching a document with conditions to the request (aka Conditional Acceptance).
  • BRIAN joined the conversation, discussing the statute of limitations for any debt with the IRS and the potential for a Collection Due Process request to pause this. TJ emphasized do your research and you will find that the IRS lacks Implementing Regulations as required by the Federal Register Act, which means the IRS may have no regulatory authority to collect.
  • Bouyea decided to read more about the collection due process request and consider setting up a trust while going through this process.

Trust Setup and Debt Validation

TJ advised Emily to prioritize setting up a trust and opening a bank account before starting the debt validation process. He emphasized the importance of timing in legal matters and suggested that having assets in the trust before any legal action would be beneficial. TJ also advised EMILY to apply for credit if necessary and to start the debt validation process once delinquencies begin. He reassured her that the chances of negative credit reporting in the short term are low. Emily expressed her concerns about balancing the need for credit while challenging debts and starting a business. TJ encouraged her to think strategically and to focus on setting up the trust first. As always, do your homework and use the law.

Private Marriage Contract  Evidence

Roy and TJ discussed the process of using a private contract as evidence of marriage, particularly in relation to visa and residency issues. Roy, who is planning to marry a Mexican national, was advised by TJ to research the Federal rules of evidence regarding marriage and to consider using a family record or a published document as evidence. TJ also explained the importance of understanding one’s role in a trust and the distinction between a person and an agent. ARMEN, a green card holder, asked about using a non-resident registration document as a birth certificate for a trust, to which TJ responded that the document serves as the birth certificate of the estate, not the person. TJ emphasized the importance of operating through a trust to more effectively change one’s status in one’s daily activity.

Credit Cards, Debt and Validation Laws

Tj and Armen’s discussed various topics related to credit cards and debt validation. Tj advised Armen’s to choose his tools wisely and to request authenticated evidence from the credit card company. They also discussed the power of banks to report negative information to credit bureaus and the potential for banks to break rules. Tj suggested that Armen’s could send a cease and desist letter to the credit card company. Brian asked about the legality of lawyers representing third parties in small claims court, to which Tj responded that it depends on the state.

Finally, ROBERT shared his experience of being sued by Capital One and sought advice on his next steps. Tj advised Robert to use court procedures against the credit card company and consider filing a countersuit in small claims court.

Trusts, Debt Elimination, and Asset Protection

TJ discusses various topics related to trusts, debt elimination, and asset protection strategies. He advises JB to delay answering questions about assets from the SBA loan officer until after setting up a trust. But always answer truthfully. TJ explains to Robert that the Tax-Free Trust program is separate from the Gold Delete Debt membership course he purchased. Contact Tj by email to discuss a credit for the previous purchase if within 30 days of course purchase.

TJ suggests Crystal consult the bankruptcy court rules before transferring property into a trust during an ongoing Chapter 13 case. He mentions potentially offering a new course on legally obtaining funds from the government without repayment.

Overall, TJ emphasizes following proper legal procedures, being truthful, and using tools within the system for asset protection and wealth building.
